AppNeta, Inc. (“AppNeta,” “we” or “us”) is committed to protecting your privacy through our compliance with the AppNeta Privacy Policy (this “Policy”).

This Policy describes the types of information we may collect from you or that you may provide to us when you visit our website at or use the services we offer to our customers. In this Policy we refer to our website and our services collectively as the “Services.” This Policy also describes our purpose and practices for collecting, using, maintaining, protecting and disclosing that information.

This Policy applies to information we collect through the Services and to information you send to us.

It does not apply to information collected outside of the Services or by any third party.

By using or accessing the Services, you agree to the policies and practices described in this Policy. If you are (or work for) an AppNeta customer, this Policy is also part of the AppNeta Terms of Service or other customer agreement between you or your organization and AppNeta (the “Terms of Service”), and your use of or access to the Services is subject to your agreement with all of the terms and conditions of the Terms of Service. If you do not agree with any part of this Policy or, if applicable, the Terms of Service, you may not access or use the Services.

Information We Collect

We collect several types of information from and about users of the Services:

  • “Non-Personal Information” by which you cannot be personally identified, which may include anonymous usage data, general demographic information, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks; and
  • “Personal Information” by which we can identify you, which may include your name, email address or other contact information, or any other identifier by which you may be identified personally.

Except as otherwise described below, the data collection and uses described in this Policy are required in order for us to be able to provide the Services you or your organization have requested. If you do not agree, you may not use the Services.

In some cases, our collection and use of data is based on legitimate interests we may have, such as to analyze and improve the Services or to communicate with you to provide you with information about the Services. When this type of data includes Personal Information, you may object to our collection and use as described below, and we will address your objection promptly.

In limited circumstances, our basis for collection and use of Personal Information is your consent. Where that is the case, we will give you a choice, and you may use the Services even if you have not provided consent to the particular use.

In addition, in an effort to improve the quality of the Services, we track and store information provided to us by your browser, such as the website you came from (known as the “referring URL”), the time and date of access, and other Non-Personal Information. We track this information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and are stored on the user’s computer.

We may use both persistent and session cookies. Persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser. For example, we may store a persistent cookie to enable us to pre-populate form fields that you have previously completed or remember your user preferences. Although you can disable cookies on your device by indicating this in the preferences or options menu in your browser, doing so may limit your ability to view or use the Services, or you may have to re-enter form fields or re-establish your user preferences.

Finally, If you or your organization have installed our Native Monitoring point software on your workstations, the AppNeta Performance Monitor will collect and locally store information about certain specifications and performance of your device and local network. This information may include the username of the logged-in user, CPU memory utilization, local disk storage capacity and availability (but not contents), top processes (but not underlying activity), Wi-Fi network name, Wi-Fi signal quality and bandwidth data, BSSID, SSID, and MAC address. This information is not automatically transmitted to AppNeta but retrieved on-demand to assist your organization’s technical administrator with troubleshooting performance problems. To the extent shared with us, we use this information solely to provide technical support to you or your organization as part of the Services.

Information you provide to us

The information we collect includes information you provide to us when you use the Services, such as when you fill out forms, request a demonstration or free trial, contact us for support, or sign up as a customer or customer user. This information may include your name, email address and other contact information, company affiliation and job title, and other Personal Information. In connection with support requests, we will also collect your browser name and version and a description of your support problem. By submitting this information, you are authorizing us to collect, store and use your Personal Information in accordance with this Policy.

Third-Party Websites and Tracking

We may provide links to third-party websites or applications through the Services. In addition, we use third parties to provide analytics and similar services to us in connection with our effort to improve the Services. For example, we use Google Analytics to help us understand how users use certain features of the Services and to generate reports about aggregate uses that help us measure and research the effectiveness of various features of the Services. These third parties may use cookies or other tracking technologies to collect applicable information. How We Use and Share Information

We may use and disclose Non-Personal Information and aggregated, anonymized information about our users without restriction.

We may use and disclose Personal Information as described in this Policy:

  • to the extent necessary for the performance of our contract with you or your organization, including,
    • to provide the Services to you or your organization;
    • to enable our service providers to support elements of our business, such as payment processing, hosting services, and customer relationship management services;
    • to fulfill any other purpose for which you provided it, such as to respond to your requests, or provide technical support;
    • to carry our obligations and enforce our rights under the Terms of Use;
  • to the extent necessary or useful in connection with our legitimate interests, including,
    • to a buyer or other successor of our company in the event of a merger, acquisition, sale of assets that includes the Services;
    • to inform you about our products and services;
    • to comply with a court order, law or legal process;
    • if we believe disclosure is necessary to protect the rights, property, or safety of AppNeta or its personnel, customers, or others; or
  • for any other purpose disclosed by us at the time you provide the information, or with your consent (which you may withdraw at any time).

Retention of Personal Information

AppNeta will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by applicable law.

How We Protect Information

We have implemented commercially reasonable and appropriate security measures designed to protect your information from accidental loss and from unauthorized access, use, alteration and disclosure. These measures include technological security measures including encryption, firewalls and secure socket layer technology.

The safety and security of your information also depends on you. For example, where we have assigned or you have chosen a username and password to access certain parts of the Services, you are responsible for keeping your username and password confidential.

No electronic transmission of information is completely secure, and no security system is impenetrable. AppNeta does not guarantee the security of your Personal Information. By using the Services, you acknowledge that you understand and agree to assume these risks.

Your Rights Regarding the Collection and Use of Personal Information

You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt-out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. You can also indicate that you do not wish to receive marketing communications from us by emailing Please note that, notwithstanding the promotional preferences you indicate by either unsubscribing or opting out, we may continue to send you administrative emails including, for example, periodic updates to this Policy.

You may have other rights under applicable data protection laws. For example, if you are a resident of California, then under California law, including the California Consumer Privacy Act (“CCPA”), you may have specific rights relating to your Personal Information. Your rights depend on the nature and purpose of the collection and use of your Personal Information and may include the right to be informed about categories of Personal Information we collect, categories of the sources of Personal Information, and categories of third parties with whom we share Personal Information. This information is provided in the applicable sections of this Policy. You may also have the right to request information about the specific Personal Information we may have about you, and you may do so by contacting us as set forth below. In some cases, you may have the right to request that we delete Personal Information we may have about you. We will respond and, where applicable, comply with your requests free of charge and within the timeframe required under applicable law.

We do not sell Personal Information for direct marketing or any other purpose. Therefore, the elements of CCPA or other applicable law relating to the sale or “commercial” use of Personal Information do not apply to us. Similarly, we do not track users over time across third-party websites, and therefore we do not recognize or respond to browser-initiated “do not track” signals. You do not need to establish an account with us in order to send us a request, but if you already have an account with us, we may communicate with you about your request through your account. We do not discriminate against our users based on their data-privacy choices or the exercise of their rights under applicable data protection laws.

We respect the privacy rights of all our users. We are committed to complying with data protection laws to the extent they apply to us, and to assist our customers in their compliance obligations as applicable and appropriate. Please note that your rights under certain data protection laws depend in part on the nature of your relationship with us. Because we may only access and use our customer’s data (which may include your Personal Information) in accordance with instructions from the applicable customer, if you are a customer user and you make your request directly to us, we will refer your request to that customer, although we will support them as required by applicable data protection laws in responding to your request.

Users from Outside of the United States

AppNeta is based in the United States, and the servers and other infrastructure through which we provide the Services are located in the United States. Any Personal Information that we collect about you or that you provide to us will be transferred, processed and stored to the United States. By using the Services and submitting any Personal Information or allowing us to collect Personal Information from you through the Services, you expressly authorize this transfer.

Customers based or with operations in the European Union may enter into a separate Data Processing Addendum with us, which addresses specific requirements under applicable data protection laws.

Children’s Privacy

AppNeta does not knowingly collect or solicit information from anyone under the age of 13, and no one under age 13 is permitted to provide any information to AppNeta. If you are under 13, do not use the Service for any reason. If we learn we have collected or received information from or about a child under age 13, we will delete that information. As with the Terms of Use, AppNeta reserves the right to change this Policy at any time, without notice to you. Any modifications will be effective immediately as of the date the modified Policy is made available through the Services.
